THESE RULES APPLY TO ALL SWEEPSTAKES AND/OR CONTESTS SPONSORED BY CALIFORNIA INNOVATIONS, INC. CHANCE PLAYS NO PART IN THE SELECTION OF WINNERS IN CONTESTS. NO PURCHASE NECESSARY TO ENTER OR WIN ANY SWEEPSTAKES OR CONTESTS (AlSO REFERRED TO AS THE “PROMOTION”).

The opening and closing dates for the receipt of entries in each Promotion will be posted in the relevant “Promotion Description” shown on the Sponsor’s website.
Promotion is open to legal residents of the United States and Canada (except as stated below), who are at least 21 years of age at the time of entry. Personnel of the Sponsor, its subsidiaries and affiliates, its agents and advisors, and their household members may not participate. Promotion is void in Arizona, New Jersey, Puerto Rico, Vermont, Quebec, and where prohibited by law.
To enter, log on to www.californiainnovations.com and follow the instructions for completing the information required on the Promotion entry form. There is no entry fee.
Only on-line entries will be eligible. Your entry signifies that your entry complies with all of the requirements of these Official Rules. You can only submit one entry. If the entry is a recipe or similar creative expression, it must be, in its entirety, a single work of original material created by the Promotion entrant. Sponsor will disqualify previously published recipes, such as those found in cookbooks and magazines or on websites.
The Sponsor’s panel of judges, acting in their sole discretion, will select the winning entry from eligible entries using criteria set forth in the relevant Promotion Description. Potential winners will be required to show proof of being the authorized e-mail account holder and will be required to certify, on information and belief, that their recipe or other creative expression is their own creation and has not been published, publicized or a winner of a national promotion. For recipe promotions, Sponsor or its designated agent will select and supply the cooking equipment and ingredients to be used in the judging. Sponsor or its designated agent may substitute comparable ingredients. The winner of the Promotion will be chosen within thirty (30) calendar days of the closing date of the Promotion. The decision of the Sponsor shall be final and binding.
The winner will be chosen by random drawing conducted on the date set forth in the Promotion Description by an independent judging organization from the eligible entries. The decision of the Sponsor shall be final and binding. Odds of winning depend on the total number of eligible entries received and will be stated in the Promotion Description. To be declared a winner, any Canadian resident selected in the drawing will be required to correctly answer without assistance of any kind, whether mechanical or other, a time-limited mathematical skill question. The question will be administered by telephone at a pre-arranged, mutually convenient time. In the event that a selected Canadian entrant is unable to answer the mathematical skill testing question correctly or cannot be reached in a reasonable time after the drawing, the Sponsor shall have the right to disqualify said entrant and to randomly draw another eligible entry, and the Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard.
If a selected entrant is not eligible or does not otherwise meet the requirements as set out in these Official Rules, the Sponsor shall have the right to disqualify said entrant and randomly draw another eligible entry, and the Sponsor shall be fully and completely released and discharged from any liability of responsibility in this regard.
The winner(s) will receive the prize(s) set forth in the relevant Promotion Description. All taxes/duties are the winner’s sole responsibility. The winner will receive notice of the prize via e-mail sent to the address provided by entrant. Sponsor is not responsible for any lost prize and no substitute prize will be provided. If the package is returned to Sponsor due to errors in address provided by the winner, it will result in forfeiture of the prize and selection of an alternate winner from remaining eligible entries. The total approximate retail value of the prize(s) will be set forth in the Promotion Description.
The winner may be required to sign and return an Affidavit of Eligibility, and, where lawful, a Liability and Release within fifteen (15) calendar days of notification by Sponsor. If any potential winner cannot be contacted, or fails to sign and return the Affidavit of Eligibility and/or Liability and Release, the winner's prize may be forfeited and an alternate winner selected, except where prohibited by law. By accepting the prize and/or executing the Release, the winner agrees that Sponsor may post winner's name and may use winner's name, voice, likeness, biographical information, winning recipe or other creative expression, and statements attributed to winner (if true) for the purpose of promotional purposes without further compensation.
The name of the winner of a particular Promotion and/or a copy of these Official Rules will be available to persons who send a stamped and self-addressed envelope to California Innovations Inc., Attn: Promotion Department, 36 Dufflaw Road, Toronto, Ontario M6A 2W1, Canada, or send an e-mail message to service@ca-innovations.com with “Winner’s Name” as the subject. Requests for the winner’s name must be received within thirty (30) calendar days of the closing date of the relevant Promotion. U.S. residents may omit return postage.
By entering the Promotion, all entrants grant an irrevocable perpetual, nonexclusive license to Sponsor, to reproduce, distribute, display, and create derivative works of the entries (along with a name credit) in connection with the Promotion and promotion of the Promotion, in any media now or hereafter known, including, but not limited to publication online highlighting entries or the winner of the Promotion. Entrants consent to the Sponsor doing or omitting to do any act that would otherwise infringe the entrant's "moral rights" in their entries. Display or publication of any entry on Sponsor’s website does not indicate the entrant will be selected as a winner.
Sponsor may disqualify any individual tampering with the Promotion, acting in violation of these Official Rules, or in a disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Promotion can be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver. Sponsor, its affiliates, directors, officers, employees, agents, and advisers are not responsible for (i) any events beyond their control that may cause the Promotion to be disrupted; and (ii) any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the Promotion. Sponsor reserves the right, in its sole discretion, to suspend or cancel the Promotion in the event of technical difficulties.
By participating in the Promotion, you agree to release and hold Sponsor, its affiliates, directors, officers, employees, agents, and advisers harmless from any and all losses, damages, claims and actions of any kind in connection with the Promotion, or resulting from acceptance, possession, or use of the prize, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.
Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Promotion, or the prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by the courts located in Toronto, Ontario, Canada; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion but in no event attorneys’ fees; and (iii) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental and consequential damages. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. The validity, interpretation and enforceability of these Official Rules shall be governed by and construed under the laws of Ontario and Canada, without giving effect to conflict of law rules.
